The terms and conditions are here with the express aim to be as fair as possible in expected media use to protect both my own copyright and the buyer’s purchase. Please read carefully before making a purchase or using images from this site. Content must not be downloaded, copied or used without express written permission from Merrian Dennis.
All artworks presented for sale on merriandennisart.com are original artworks by Merrian Dennis /or limited edition impressions of original artworks where a maximum edition of 25 numbered/signed prints (where all impressions sold from a limited edition run are assigned a number in correspondence with the order in which they were produced) and a maximum number of 25 digital downloads are offered.
Please keep in mind that digital representations of the artwork are best possible representation of the work that I can provide, please remember that screens are backlit and colours may vary slightly on each screen. Please see my return policy. I’m happy to take further photos for you if needed, contact me, particularly if you would like a sequence of three or more to feature as a set.
*Please note that whilst care has been taken in the setting up of this online store, it is a digital platform and as items are original pieces, there may be times where someone purchasing at the same time as another online may create an issue for purchase due to timing, potential page caching and payment portal processing times. I will do my best to facilitate best outcomes for each buyer and appreciate your support and understanding as needed.
Allow 10-14 days for delivery for artworks and brooches, after payment has cleared. If you need something sooner please contact me directly for an express post option.
Purchasing from Merrian Dennis on this site allows for the following permissions;
Digital and non-digital files are for personal use only and shall not be submitted to contests, reproduced for commercial use. Merrian Dennis, the Artist, grants the buyer a non-exclusive, non-transferable, perpetual, personal-use license to reproduce media via print only for any non-commercial use, including but not limited to reprints, enlargements, gifts to family and friends, slide shows, and web pages. A direct link or credit is towards merriandennisart.com is appreciated, where possible when digital images of the media are used, especially on social media platforms and web pages.
Title and ownership, and all rights now and in the future, of and for the media remain exclusively with Merrian Dennis, the Artist.
Personal, non-commercial use of the media includes: display on personal computers/devices and making image prints for personal use.
You cannot use the media in an obscene, illegal, immoral, libellous, or defamatory manner. You must not incorporate the media into trademarks, or logos. You cannot make the media available for download.

Refunds and Returns
I offer the buyer a 7 day return period from the time of receiving delivery of the artwork should you change your mind once they see the artwork in person. The buyer must call me to discuss their request to return the artwork. The cost of return shipping will be covered by the buyer and the amount refunded will be less the postage of sending the artwork, and amount agreed during the conversation with Merrian Dennis. If the artwork is returned in any condition less than when it was sent originally, the purchaser will have any additional costs subtracted from their refund.
Returns are not available for items damaged in shipment. These will be covered as part of the insurance attached to the delivery.
Payment Methods & Delivery:
The shopping cart plugin provides you with the opportunity to pay offline via direct deposit or online using direct deposit and your own internet banking, or with credit card payment (American Express, Master Card & Visa Card) via PayPal credit card portal or by logging in to your PayPal account.
Credit/debit card details are encrypted at all times will only be ‘live’ during the actual transaction. If you choose to check out as a guest for peace of mind and security you will be required to re key these numbers on any subsequent orders.
If you choose to create a user account or subscribe to our mailing list you can be assured that we do not share your information with any external parties and you have the capacity to unsubscribe at anytime.
Alternative order method:
Use the pay by direct credit option, the artwork you have selected is ‘held’ until payment is confirmed. You then have two option: either direct deposit the amount (details on order email received) or call Merrian Dennis, the payment can be processed as a phone order via Square.
Delivery:
I use Australia Post Postal Services & Express Post Couriers to provide economic door to door delivery services to locations right across Australia.
Normal shipping takes approximately 10 – 14 working days. All orders are processed within 24 – 48 hours except weekends and public holidays or special holiday shutdown periods (eg. Christmas & New Year, etc), pending on credit card authorisation.

Using our online store:
When you use our online contact form or when you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
Email use, marketing newsletters:
With your permission, via a checkbox on our online contact forms, or through business networking, I may send you emails about new artworks available or exhibitions coming up. I respect your privacy and do not mail out extensively.

How do you give consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.
If we ask for your personal information for a secondary reason, like marketing newsletters, we will ask for your consent. All of the contact forms on my website give you the option to opt-in/out at anytime.
How can you withdraw consent?

How is our store hosted – use of third party applications:
Our store is hosted on an e-commerce platform that allows us to sell our products and services to you. We have SSL encryption on our site. Payment gateway data is not stored on our website, only billing or shipping addresses, never cards. When you return to our website to make further purchases you will need to re-enter your payment details via PayPal, or login to your PayPal account, or request payment by direct deposit.
Website analytics and cookies – use of third party applications:
To improve your experience on our site, we may use ‘cookies’. Cookies are an industry standard and most major web sites use them.
